Terms Conditions



We have furnished complete information on the Tour Arrangement / Itinerary / Pricing and ‘Terms and Conditions’ for the relevant tours. You shall read the same carefully before filling and signing the Booking Form. The Terms and Conditions that appears on the Booking Form and Payment Receipt shall be binding on the parties and shall constitute a contract between the parties.

Travel Organizer India hereafter referred to as ‘The Company’ accepts bookings subject to the ‘Terms and Conditions’ outlined herein. ‘The Client’ refers to the person/s in whose name and/or whose behalf the booking is made and/or whose name appears on the Booking Form and Invoices and includes every person availing the services of the Company. ‘Third party product’ refers to products designed and operated by any person or concern other than the Company and include cruises, rail passes / tickets, hotels, transportation etc.

Booking
The signing of the Booking Form and the ‘Terms and Conditions’ by you shall confirm the acceptance of the ‘Terms and Conditions’ contained herein by you in totality. The Company will not accept any booking where the Booking or Indemnity Form is found to be incomplete in any respect.

No booking shall be considered confirmed until a written confirmation slip to this effect has been sent to the Client along with the full amount duly paid and cheques honoured.

However, the Company reserves the right to decline booking any person/s request for any tour or to cancel their booking without assigning any reason. This includes the company’s right at any point of time to:

  • Terminate the contract prior to the commencement of the tour without assigning any reason whatsoever.
  • Amend, alter, vary or recall any tour/excursion/facility it has advertised or published or substitute a service by a service of similar quality if it is deemed necessary.
The Company reserves the right to alter the published price of any tour at any time due to factors including increase in tariffs, entry fees or exchange rate fluctuations. Such amounts shall be determined at the sole discretion of the company.

Deposit & Payment
A non-refundable deposit of 25% is required to secure a booking. This amount forms part of the payment for the tour and shall be adjusted to the total amount charged to the Client.

Passengers booking within 25 days of tour departure are required to pay the full amount immediately to avoid cancellation of the seat. In the event that the full amount is not paid within days prior to departure, the Company reserves the right to consider the booking as cancelled and the deposit shall be forfeited.

Cancellation
If the cancellation of the tour arises from the Client, he/she are required to intimate the Company in writing by mailing us at our office address on working days during office hours. If the Booking Form has been signed by one or more persons for themselves as well as for other persons mentioned in the Form, request for cancellation signed by such signatories would be treated as valid communication for cancellation for all such persons mentioned in the Form. In case of cancellation, the following cancellation charges would apply:

If a booking is cancelled less 25 days prior to the tour departure date, then the following cancellation charges apply:

25-15 Days - 50% Cancellation Fee
14-07 Days - 75% Cancellation Fee
06-00 Days - 100% Cancellation Fee

Any passenger joining after the departure date, or not at all, or leaving before the completion of the tour for any reason whatsoever, is not entitled to any refunds whatsoever from the Company, or entitled to claim any costs for any added expenses.

Should a client intend to switch from one tour to another a standard fee is payable. Should the change be made within days of departure, standard cancellation fees apply.

Cancellation of the Tour by Company
In the event that the Company cancels a particular Tour, the Company shall refund the amount of the cost of the said Tour to you after deducting the expenses incurred by the Company on insurance premium and other overheads as applicable. The Company shall not be liable to pay any compensation, interest or damages to you.

In the event that the Company decides to amend or alter any tour or holiday advertised in their website after the bookings have been made but prior to departure, the Client shall have the option to continue with the tour or holiday as amended/altered or to accept any alternative tour or holiday, which the Company may offer.

In either of these above cases, the Company shall not be liable to the Client for any damage, additional expenses, or refund.

Travel Documents
It is the client’s sole responsibility to arrange, and carry tour valid travel documents and ensure that they have their passports, visas, health certificates and other required documentation in order. Passports should have 3-4 blank pages available.

The Company shall not be liable for any damages or claims if the client prior to commencement of the tour does not correctly attend to such paperwork including travel insurance to cover risk to life, limb and property.

The Company reserves the right to ask any Client to provide written confirmation of his medical fitness before departure. In the event that a medical condition has not been disclosed and wherein the interest of the group is affected, the Company will not be liable to offer any assistance or money back.

Baggage
Baggage and personal effects are at all times and in all circumstances the Client’s responsibility and the Company does not accept any liability for any loss or damage ensuing in any manner. The Client is advised not to carry valuables on the tour.

Hotel
In case of a request in writing for preference of rooms at the time of booking by the Client, the Company would make every effort for the same. However, as room allocation is determined by the management of the hotel, there is no guarantee in this regard.

Risk
The Client acknowledges that all tours have an element of personal risk and accepts full responsibility for any risks involved. Neither the Company nor any of its agents shall be held liable in any way for any injury, loss of life or damage to property, howsoever caused. The Client hereby indemnifies the Company and its agents from any such claim.

Marketing
The Company reserves the right to use any photographs/video taken during tours for use in marketing or any other advertising material. The client hereby gives consent for the same and for the Company to retain copyright over such material.

Conditions of Travel
The Clients shall not behave in a manner so as to become a nuisance to the group or cause distress or annoyance to co-travellers. Should the client do so during the tour, the driver/guide may order the client to leave the tour without any claim to a refund.

Third Party
In the event that the tour involves a third party tour or travel product/services like cruise, flights, coaches, the Terms and Conditions specified by such Tour Operator, which includes their payment schedule, cancellation, refund etc. shall be applicable, in addition to our Terms and Conditions.

Since we have no direct control over such services or persons providing such services we cannot be held responsible if the contemplated service is not provided by the supplier or is found to have a defect or deficiency in the services provided by a third party. Any instance of delay injury, death, loss or damage caused on the above account does not render us liable to the Client. However, in the latter case, we can take up the matter with the supplier if we are intimated immediately.

Force Majeure
The Company shall not be held responsible and/or liable for any damages caused to the Client due to reasons beyond the control of the Company. These unforeseen circumstances include but are not limited to war, mechanical breakdowns, weather, riots and possible occurrences or consequences arising out of these may cause delays or alterations to the tour.

Jurisdiction
Law prevalent in India is applicable. As the Company has its Registered Office in New Delhi, it is agreed between the parties that in the event of a dispute or difference between the parties the exclusive jurisdiction shall vest in the court / tribunal of Delhi. The Company at its instance will have the discretion to sue in the High Court if and when it deems appropriate.
